Hate speech against the Rom community pronounced by a member of the “Lega Nord” political party during a television program was an expression of “collective discrimination” in the meaning of Article 5.3 of legislative decree No. 215 of 2003. Consequently, the NGOs ASGI and NAGA were entitled to bring an action on compensation before civil courts as representatives of the Rom community and its interests and rights. The defendant did not enjoy, in the case, the immunity as a member of the European Parliament and had to pay an amount of 6,000 euro to each Organizations as compensation for non-pecuniary damage.
