The principle of reciprocity in the treatment of foreigners under Article 6 of the civil code preliminary provisions does not apply as regards the enjoyment  of fundamental human rights. With regard to non fundamental civil rights and, most particularly, the right to contract, the foreign immigrants legally staying in Italy are entitled to make private contracts irrespective of reciprocity.
