Decision of the Court of Cassation, I Civil Section, No. 11226 of 29 April 2014

The judgment of an ecclesiastical court which annulled a marriage may be declared enforceable in Italy even in the case that an Italian court had pronounced a divorce judgment. The fact that the cause of the nullity of the marriage is not foreseen as such into the Italian legal order is not an obstacle for enforcing the decision of the ecclesiastical court in Italy.
