Response of the Italian Government to the Report of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) on the visit to Italy from 14 to 18 June 2010, CPT/Inf (2013) 31, 19 November 2013

The Response of Italy to the Report drafted by the European Committee for the Prevention of Torture following his visit to Italy in 2010 is divided in two parts. The first one contains the observations of the Italian government regarding the prevention of suicide and self-harm in the prisons, the identification of prisoners who may be at risk, and the measures taken in the event of death or self-harm in custody. Moreover, Italy provided further information on certain aspects of the transfer of responsibility for prison health-care from the Ministry of Justice to the regional health-care authorities. The second part of the Response contains supplementary observations on the accountability for ill-treatment of persons in custody. It clarifies the national legal framework applicable to disciplinary and judicial proceedings in the case of violation of duties, including mistreatment of persons under arrest or of protesters: in the opinion of the government these norms make it irrelevant the lack of the specific offense of torture and ill-treatment in national legislation. In paragraph 31, information is provided concerning the criminal proceeding for the events that occurred at Bolzaneto, during the G8 Summit of 2001 in Genoa.
