Order of the Court of Palermo of 8 March 2013

In deciding on the appeal against an order through which the Judge for preliminary investigation had refused to put an end to the pre-trial detention of the claimant, the Court of Palermo observed that, according to the Constitution, limits in personal freedom deriving from remand must be reduced to strict minimum necessary. This criterion is also in line with the ECHR, as interpreted by the European Court of Human Rights, most specifically in its judgment of 8 January 2013 on the case Torreggiani at al. v. Italy.
