Order of the Court of Genova, XI Civil Section, No. 9 of 30 June 2016

The Court of Genova examined a recourse by a citizen of Mali against his exclusion from any form of international protection under Italian legislation on immigration, decided by the relevant territorial Commission. The Court considered the requirements laid down in national legislation for recognizing the refugee status, the so-called ‘subsidiary protection’ or the ‘humanitarian protection’, respectively. It found that the claimant had the right to have recognized humanitarian protection in Italy because the situation in Mali was such to put at risk his fundamental human rights and, on the other hand, there was sufficient evidence of his satisfying social integration in Italy.
