It is discriminatory to refuse the family allowance to a Chinese woman legally staying in Italy from many years, who has a residence permit for working, and is the mother of three children. Such conduct amounts to an act of discrimination on the ground of nationality and, thus, in breach of non-discrimination against, and equality of aliens under Article 14 of the ECHR (in conjunction with Article 8, on the right to respect for family life) and Article 12 of EU directive 2011/98, as interpreted by the EU Court of Justice.
