Order of the Court of Cassation, VI Civil Section, No. 12333/17 of 5 December 2016

The Court of Cassation annulled the decision of the Appeal Court of Rome, which did not recognize the international protection to a woman victim of domestic violence in Morocco, her country of origin. Based on the definition of ‘domestic violence’ laid down in the Istanbul Convention of the Council of Europe and the relevant Italian legislation, the claimant was entitled to international protection because the Moroccan authorities failed to give her effective protection from her husband’s acts of violence.
