Judgment of the European Court of Human Rights, II Section, 7 January 2014, Cusan and Fazzo v. Italy (Application No. 77/07)

On the case challenging the transmission of the father’s surname to his children., the Court held that the decision to name a child based on transmission of the father’s surname was based solely on discrimination on the ground of the parents’ sex, in violation of Article 14 (prohibition of discrimination) of the ECHR, taken together with Article 8 (right to respect for private and family) of the Convention.
