European Committee of Social Rights, Decision on admissibility and the merits, Confederazione Generale Italiana del Lavoro (CGIL) v. Italy (Complaint No. 91/2013) (Publicity: 11 April 2016)

With regard to the complaint submitted by the Confederazione Generale Italiana del Lavoro (CGIL) concerning the unsatisfying application of law  no. 194 of 1978, the European Committee of Social Rights stated that the high percentage of conscientious objectors of medical staff in relation to abortion services, and the failure by the competent national and regional authorities to take the necessary steps to enforce the law on abortion violate women’s right to health and the right to work for non-objector health personnel.
