Decision of the Regional Administrative Court for Sicilia No. 424 of 15-29 January 2014

The Regional Administrative Court for Sicily contested the  jurisdiction of any national court with regard to the implementation of the ECHR Court decision of 16 October 2012 in the case Cappello v. Italy concerning the violation of the reasonable length of proceedings. The Regional Administrative Court for Sicily noted, however, that the decisions of the European Court are not immediately enforceable, because the ECHR does not contain any provision to this end. The individuals may however request the execution of decisions of the ECHR Court within the framework of the procedures provided by the Rules of the Committee of Ministers of the Council of Europe concerning supervision of the execution of judgments and of the terms of friendly settlements.
