Decision of the Regional Administrative Court for Liguria No. 321 of 3 March 2016

The Regional Administrative Court of Liguria declared inadmissible a recourse submitted by five non-profit organizations against an order of the Major of Alassio. This order prohibited to the nationals of certain African, Asian and South American Countries, to stay, even occasionally, in the municipal territory, if not with a certification attesting the absence of infectious and transmissible diseases. For the Administrative Court, human rights non-profit organizations are entitled to recourse before courts only in case of collective discrimination, and when it is difficult or impossible to identify the victims by name. Furthermore, since the right to non-discrimination is a subjective right of the individuals, decisions on the alleged violations fall within the competence of the regular courts and not the administrative ones.
