By decision No. 6568/2016, the Regional Administrative Court for Lazio upheld the appeal of two Ukrainians to whom the Italian Embassy in Kiev had denied the granting of entry visa for the ‘elective residence’ in Italy. For the Court, the Embassy had taken this measure without adequate ascertainment on the existence of substantive reasons; moreover, the measure was not adequately motivated. Most in particular, the Embassy had not duly taken into account the intention of the applicants to stay in Italy for a short period (maximum one year); moreover, it had not adequately assessed whether the amount deposited by the applicants at a national bank was a sufficient guarantee of their ability of staying in Italy without performing any work.
