Decision of the Regional Administrative Court for Lazio, II Section quater, No. 6076 of 27 March 2014

By judgment 6076/2014, the TAR of Lazio annulled a decision by the Ministry of Interior, which rejected an application for the granting of citizenship submitted by a foreigner married with an Italian woman. Based on Article 6 of law No. 91/1992, the granting of citizenship to the spouse of an Italian national may be refused only for proved and substantive reasons concerning national security. Based on these principles, the TAR ruled that the challenged decision was not sufficiently motivated; further, there was no evidence, in the case, about the applicant’s social dangerousness.
