The Court of Rome stated that, following the modification introduced into the legislation on the acquisition of Italian nationality through law No. 94 of 2009, the acquisition of nationality iure communicationis, i.e. in consequence of the marriage with an Italian citizen is not possible if the death of the Italian spouse intervenes before completion of the related administrative procedure. Not at variance with any other cause of marriage dissolution, the death of the Italian spouse makes that the acquisition of nationality by the other is no longer allowed.
