Decision of the Court of Rome, I Civil Section, No. 15397 of 24 June 2016

Based on the UN Convention on the status of stateless persons, a Cuban woman was entitled to the stateless status. The Court of Rome grounded its decision on the fact that the claimant was regarded as ‘migrant’ in her country of origin, due to her departure from Cuba and her staying in Italy for 7 years. For the Court, the recognition of the status of stateless person derived from the fact that the claimant had lost, under Cuban law, the fundamental rights attached to citizenship. In addition, she had not the nationality of other States, nor the Italian nationality and lacked necessary requirements for the acquisition of the latter.
