Decision of the Court of Messina, I Civil Section, 30 May 2017

Few months after the decision of the ECHR Court on the case Talpis v. Italy, the Court of Messina affirmed the accountability of the Public Prosecutor for the failing of investigatimg and taking measures in relation to repeated denunciation of a woman who was subjected to to ill-treatment and violence from her husband, who later killed her. Ten years after the homicide, the Court has ascertained “a violation of law for non-excusable negligence” by members of the judiciary and has condemned the Presidency of the Council of Minister to pay compensation to the children of the victim.
