Decision of the Court of Cassation, VI Criminal Section, No. 33983 of 11 June 2015

Confirming its earlier rulings on the subject of international abduction of children, the Court of Cassation restated in this decision the principle that the judge must balance the freedom of establishment of the custodial parent with the right of the child to maintain his/her relationship with the other parent, in order to correctly apply the relevant provisions of The Hague Convention of 1980.
