With this judgment, the Court of Cassation rejected the recourse against the decision of the competent Court of Appeal to execute an European arrest warrant in respect of a Polish national who had been convicted in Poland, with a final judgment, for an offense partly committed in Italy. The case gave the Court the opportunity to examine the principles concerning lis pendens and the ne bis in idem principle laid down in the pertinent EU legislation (and Italian implementing norms), the international norms applicable to extradition, and the Charter of Fundamental Rights of the EU.
