Decision of the Court of Cassation, VI Civil Section, No. 14503 of 26 March 2014

The Court of Cassation upheld the appeal of a Moroccan national who had been expelled as being a ‘socially dangerous person’ merely on the grounds of a previous conviction. Expulsion by reason of social dangerousness requires that dangerousness is ascertained as real, and still existing at the time of deciding on expulsion.
