Decision of the Court of Cassation, United Sections, No. 19978 of 15 July 2014

The Court of Cassation stated that Italian courts have jurisdictional competence over bankruptcy proceedings concerning companies based in Italy, which transferred their activities in a non- European State (in the case, the Republic of Mali) shortly before the bankruptcy filing, and just with a view to escape Italian jurisdiction.
