Decision of the Court of Cassation, United Sections, No. 13941 of 8 April 2014

With this decision the Court of Cassation confirmed a principle well established in its earlier jurisprudence, according to which in the case of disputes concerning the international sale of goods, jurisdiction lies on the country where the final delivery of goods shall be (Italy, in the case). The Court has further enlightened the scope of EU regulation No. 44 of 2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Bruxelles I) on one hand, and the UN Convention on Contracts for the International Sale of Goods of 1980, on the other, latter being a treaty in force in respect of Italy.
