Decision of the Court of Cassation, IV Criminal Section, No. 24860 of 21 May 2015

In this decision the Court of Cassation restated a principle well established in its earlier jurisprudence: a person who was in prison abroad and has been extradited to Italy to serve the sentence, may file an application for filing an opposition despite the regular term for opposition has expired within 30 days from the date of his extradition to Italy, and not from the date in which he, or she became aware of the conviction.
