Decision of the Court of Cassation, III Civil Section, No. 19405 of 22 August 2013

The compensation for moral damage arising from the death of a relative concerns the protection of human rights, firstly the right to respect for family life, and therefore it is included in the concept of international public order. Consequently, Article 1327 of the Austrian civil code, which does not provide for the compensation, is not applicable within the Italian legal system.
