Decision of the Court of Cassation, I Criminal Section, No. 24084 of 31 March 2017

The Court of Cassation decided on the case of the holding of a knife by an Indian citizen for the purposes of sihk religion. It clarified that even if integration does not impose upon non-nationals staying in Italy the abandonment of their culture of origin, this principle may suffer limits on the ground of respect for human rights and for the national legal system of Italy. The Court refers to Article 9 of the ECHR and the jurisprudence of the ECHR Court on the Islamic veil, which recognized limits by States to the religious freedom if it hinders the protection of rights and freedoms of others, the public order or the public safety.
