Decision of the Court of Cassation, I Civil Section, No. 6032 of 14 March 2014

In accordance with Article 8 of the 1984 Agreement among the Holy See and the Italian Republic, the annulment of the marriage among two Italian citizens pronounced by the competent ecclesiastical court may not be enforced in Italy if the real intention of one of the spouses of not accepting the indissolubility of marriage was unknown to the other one, and not by fault or negligence. In these circumstances, enforcing the decision of the ecclesiastical court would be contrary to public order and, most precisely, to the fundamental legal principle of protecting trust and good faith.
