The Supreme Court clarified the definition contained in Article 1 of the 1954 Convention relating to the Status of Stateless Persons and affirmed that the stateless status of a person must be verified on the ground not only of formal requisites, but also of substantial elements to be evaluated according to the applicable norms of the country of origin. Therefore, the Court recognized the stateless status of a Cuban citizen who stayed away for eleven months from Cuba and, for this reason, lost many of his citizenship rights.
