The Court of Cassation examined the appeal against the decision of an ecclesiastical Court, which annulled a marriage because of the psychical inability of one of the spouses. The Court ruled that there were no public order limits to the enforcement of the decision in Italy. The psychical inability of one of the spouses to give his or her effective consent to the marriage is, in fact, a reason for declaring the invalidity of the marriage also under Italian law (Article 120 of civil code).
