Decision of the Court of Appeal of Torino, II Civil Section, No. 1031 of 21 June 2016

The Appeal Court in Torino confirmed the non-recognition of the refugee status to a Gambian national, member of the opposition party UDP, because the ill treatment inflicted to him by the non-democratic government of his country of origin did not fall, strictly speaking, in the concept of persecution for reason of political opinion under the Geneva Convention of 1951. The Court reformed, however, the verdict of first instance for the part in which it did not recognize that the applicant was entitled to subsidiary protection as being subjected to concrete risk of degrading treatment in the case of repatriation.
