Abstract

The Council of State accepted the appeal to obtain the residence permit for family reasons of the cohabitant of an Italian citizen. Even if law No. 36 of 2016 has not yet been implemented through the necessary regulations, the jurisprudence of the Court of Strasbourg included the rights of the subjects of de facto unions in the protection provided for by Article 8 ECHR (right to respect private and family life).
