As far as extradition is concerned, the provisions of the European Convention on Extradition of 1957 and of the Second Protocol to the Convention of 1978 prevail over the norms of the code of criminal procedure concerning the  precautionary measures applied to a person who is subjected to an extradition procedure. The coercive measure provisionally applied pursuant to Article 715 of the code of criminal procedure must be revoked if, within 40 days from the date of the arrest, the request of extradition and the related documents shall not be submitted to the Ministry of Justice of the requested State from the  Ministry of Justice of the requesting State or  communicated through diplomatic channels.
