The Justice of Peace (‘giudice di pace’) in Rome upheld the recourse against expulsion brought before it by a Gambian national. The decision was on the grounds of the fact that the applicant was of the age of 17 and Italian legislation on migration recognizes to the irregular immigrants who are unaccompanied minors all the rights provided by the Convention on the Rights of the Child. Decision on the expulsion of unaccompanied minors cannot be taken except by juvenile courts only by reason of public order and state defense.
