Order of the Court of Milan, IX Civil Section, of 20 March 2014

The Court of Milan decided on a number of requests introduced by the father and the mother of a minor in joint custody, including that by the father to be allowed spending more time with his daughter. In accepting this request, the Court remembered that the best interest of the child as interpreted by the European Court of Human Rights, had to be a guiding principle for deciding. On the contrary, the hearing of the child was not necessary in this case, because of the minimum impact of the decision on her usual life conditions.
