Order of the Court of Cassation No. 10375 of 21 June 2012

Through this order the Court of Cassation confirmed the rejection of the instance of a person with dual citizenship of being recognized as a refugee  or, as an alternative, to obtain international protection in Italy. For the Court, a person who have dual citizenship and cannot return to one of the countries of which it is a citizen – in the case, Nigeria, where a non international conflict was taking place at the relevant date (2008) –, must return to the other country of which he is a citizen, if he is not at risk to be threatened there by any danger.
