Order of the Court of Cassation, I Civil Section, No. 11890 of 4 May 2015

With this order, the Court of Cassation upheld the appeal against a decision establishing the adoptability of a child, which had been taken by the competent Court after hearing the child but without considering his opinion. The Court observed that the principle of hearing children, and taking into account their opinion when deciding on issues that affect them, is well-established under the European Convention on the Exercise of Children’s Rights, the New York Convention on the Rights of the Child and the relevant Italian legislation.
