Judgment of the European Court of Human Rights, IV Section, 21 July 2015, Cestaro v. Italy (Application No. 6884/11)

In:

European Court of Human Rights

In relation to the events that took place during the G8 summit in Genoa in 2001, especially in the Diaz school, the Court ruled that treatment inflicted by State agents to demonstrators integrates a violation of Article 3 of the ECHR on the prohibition of torture. Such treatment provoked in the victims feelings of fear and anxiety, as well as so serious physical and bodily harm and cruel to be defined as torture. In addition to having established the violation, the Court also ruled on the inadequacy of the Italian legislation with respect to the need of sanctioning acts of torture and deterring other similar violations in the future.
