Decision of the Regional Administrative Court for Lombardia, IV Section, No. 1472 of 2 April 2014

With decision No. 1472/2014, the Regional Administrative Court for Lombardia annulled an order through which the police authority of Lodi revoked the residence permit of a foreigner on the ground of an expulsion order against this same person. For the applicant, the revocation of his resident permit qualified as unlawful and due to misuse of powers, because the expulsion had been decided against him in the lacking of proven substantial reasons. The TAR ruled that, once the judiciary has established that the conditions for an expulsion order are not met, it derives that revocation of the residence permit must be annulled as well.
