Decision of the Regional Administrative Court for Lazio, II Section quater, No. 6321 of 15 March 2016

By decision No. 6321/2016, the Administrative Court for the Lazio region annulled a determination of the Ministry of the Interior, which denied the granting of Italian nationality on the grounds of an alleged, but not specified prejudice to the state security. The Court observed that the confidentiality of administrative preliminary activity must be balanced with the right to defense and fair trial. The administrative authorities cannot deny the disclosure of ‘confidential’ documentation, when necessary to guarantee the right to judicial protection.
