Decision of the Regional Administrative Court for Campania, VI Section, No. 2482 of 16 April 2014

With decision No. 2482/2014, the Regional Administrative Court for Campania annulled the decree of the police authority of Caserta, which had rejected the application of a foreigner to convert his residence permit for humanitarian reasons into a residence permit for employment. The contested measure was founded on the assumption of the artificial nature of the employment contract submitted by the applicant. According to the Regional Administrative Court of Campania, the decision was unlawful because there was no evidence that the employment contract was false (the testimony of a neighbor could not be regarded, per se, as an evidence).
