Decision of the Justice of Peace of Rome of 15 May 2016

Based on the New York Convention on the Rights of the Child and the Italian legislation on unaccompanied migrant minors, the Justice of the Peace in Rome upheld a recourse brought by a citizen of Gambia against an expulsion decree. There were not, in the case at hand, concerns for public order or national security, the only reasons that could justify unaccompanied minors repatriation, if authorized by Juvenile courts.
