Decision of the Court of Reggio Emilia, I Section, 22 March 2014

The Court of Reggio Emilia ruled that a cause of separation pending in Italy among two spouses, was devoid of purpose as a result of a divorce judgment issued in Morocco, and now res judicata. The Court had previously ascertained that the divorce sentence was to be declared enforceable in Italy, because issued on the grounds of the new Moroccan code on family law, which is inspired to the principles of equality and non discrimination among the spouses and, thus, conforms with the public order.
