Decision of the Court of Milan No. 12503 of 20 February 2017

With decision No.12503 of 2017, the Court of Milan condemned the editor of the newspaper “Il Sole 24 Ore” and the journalist author of the article “Gare truccate al Viminale. In bilico il vice di Manganelli” following a complaint by the Prefect and Deputy chief of the State Police. It was asserted in the article that, according to an anonymous, the Prefect was responsible for alleged favoritism in the management of the procurement of the Minister of Interiors logistics office for the acquisition of technological systems. The Court observed that the right to report protected by Article 21 of the Constitution and Article 10 of the ECHR (freedom of expression) encounters limits for the protection of the honour and the reputation of the individuals pursuant to Article 2 of the Constitution and Article 8 of the ECHR (right to respect for private and family life).
