Decision of the Court of Cassation, VI-2 Civil Section, No. 16805 of 24 July 2014

With this order the Court of Cassation annulled the suspension of a proceeding before the Court in Rome, which had been ordered by the investigating judge because of the existence of a proceeding pending in Mexico between the same parties and on the same object (Article 7 of law No. 218 of 1995, on lis pendens abroad). The reason is that the suspension should have been decided by a panel of judges and not a single judge.
