Decision of the Court of Cassation, United Sections, No. 17781 of 22 July 2013

Legislative decree No. 28 of 2010 concerning the mediation aimed at settling disputes in civil and commercial matters applies also to disputes concerning fair indemnification for unreasonable length of proceedings. Differently from the right to a fair trial enshrined in Article 6 of the ECHR, the right to compensation for unreasonable length of proceedings is of financial nature and is not an inalienable right.
