Decision of the Court of cassation, United Criminal Sections, No. 18822 of 27 March 2014

The case concerned the prosecution in absentia in Italy of a Rumanian national, who had been later arrested in his country, in execution of an European arrested warrant issued against him in a separated proceeding. The case gave the United Sections of the Court of Cassation the opportunity of analyzing the principles concerning criminal proceedings in absentia, in the light not only of Article 111 of the Italian Constitution but also of Article 6 of the ECHR, as interpreted by the European Court of Human Rights.
