Decision of the Court of Cassation, III Criminal Section, No. 17299 of 18 April 2014

In this judgment the Court of Cassation reaffirmed the principle that a company based abroad has the obligation to submit the annual income statement in Italy if it has a permanent establishment in Italy and performs its main administrative activity and all the steps necessary to achieve the social goals in the Italian territory.
