Decision of the Court of Cassation, I Civil Section, No. 6743 of 21 March 2014

Through this decision the Court of Cassation recalculated the amount of the compensation for expropriation established by the lower court, according to market value. The Court remembered that some more restrictive criteria on the indemnification for expropriation laid down in Italian legislation are no longer applicable, because the Constitutional Court declared them in contrast with the pertinent case-law of the European Court of Human Rights.
