Decision of the Court of Appeal of Naples No. 1486 of 26 April 2012

Article 4.2 of law No. 91 of 1992 establishes that the children born in Italy from foreigner parents may acquire the Italian citizenship once become adults, provided that they have legally resided in the country from birth. Taking into account the international obligations of Italy concerning children’s protection, the circumstance that the parents have omitted certain formalities for the residence permit of their child or for registering him/her, is irrelevant, if there is evidence that the child has resided effectively in the country.
